Terms of Service

1. The SageHomes Marketplace

SageHomes is an online marketplace that facilitates connections between homeowners seeking home services ("Homeowners") and independent contractors offering those services ("Contractors").

SageHomes does not perform, supervise, or guarantee any construction, repair, or other home service. All Contractors are independent businesses, not employees or agents of SageHomes.

2. Eligibility

You must be at least 18 years of age and a resident of Canada to use SageHomes. By using the platform, you represent and warrant that you meet these requirements.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify SageHomes immediately of any unauthorized use. SageHomes is not liable for losses resulting from unauthorized account access.

4. Homeowner Terms

• You may submit service requests at no cost.
• You are responsible for evaluating Contractors before hiring, including verifying licenses, insurance, and references.
• SageHomes makes no representations about the quality, reliability, or legality of any Contractor's services.
• Any contract for services is solely between you and the Contractor.

5. Contractor Terms

• You represent that you are a legitimate, independently operating business.
• You are responsible for holding all required licenses, permits, and insurance for your trade and jurisdiction.
• You agree to comply with all applicable laws and regulations in performing services.
• You will not misrepresent your qualifications or experience to homeowners.

6. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent information.
• Harass, threaten, or abuse other users.
• Circumvent the platform to avoid payments (where applicable).
• Use SageHomes for any illegal purpose.
• Attempt to gain unauthorized access to any part of the platform.
• Scrape or systematically collect data from the platform without permission.

7. Limitation of Liability

To the maximum extent permitted by applicable Canadian law, SageHomes and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform, including any services provided by Contractors.

SageHomes' total liability for any claim arising out of these Terms shall not exceed one hundred Canadian dollars (CAD $100).

8. Indemnification

You agree to indemnify and hold harmless SageHomes from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the platform, your violation of these Terms, or your interaction with any other user.

9. Intellectual Property

All content on SageHomes — including text, graphics, logos, and software — is the property of SageHomes Inc. or its licensors and is protected by Canadian and international copyright law. You may not reproduce, distribute, or create derivative works without our written permission.

10. Termination

SageHomes reserves the right to suspend or terminate your access to the platform at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion.

11. Governing Law

These Terms are governed by the laws of the Province of Manitoba and the laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Manitoba, Canada.

12. Changes to Terms

We may update these Terms from time to time. We will provide reasonable notice of material changes. Continued use of SageHomes after changes are posted constitutes your acceptance of the updated Terms.
